WorkSafe releases update on draft code of practice for roles and responsibilities in residential construction

18 Mar 2026

WorkSafe NZ has reached an important milestone in developing a new draft code of practice (ACOP) for roles and responsibilities in residential construction.

The initial draft is now complete and is being reviewed by internal stakeholders and external experts to make sure it’s practical, clear, and workable on real residential sites. This review is also checking for any gaps or risks ahead of wider consultation.

The draft is being developed alongside proposed changes in the Health and Safety at Work Amendment Bill, which would give approved codes of practice a stronger legal status through a proposed “safe harbour” approach. If the Bill is passed, this would mean ACOPs clearly set out specific, verifiable ways businesses can meet their legal duties, a move from general guidance to more directive requirements.

What this ACOP will cover

  • Roles and responsibilities under the Health and Safety at Work Act 2015
  • How businesses working together on residential sites can meet their duties

What’s next

Once the review feedback is incorporated, the draft ACOP is expected to go out for public consultation in April.

We encourage you to keep an eye out for consultation details (we will share these through our channels) and take part when the draft is released. Feedback from the sector will be critical to ensuring the final code is practical and fit for purpose.
