Your privacy is important to Site Safe New Zealand Inc. (referred to in this Privacy Policy as weour or us). This Privacy Policy is aligned to the Privacy Act 2020 and sets out the rights that you have in relation to personal information we collect.  Please take a moment to read this policy and understand it.

We may modify or amend this Privacy Policy from time to time by posting an updated version on our website (Website).  By continuing to use the Website or any of our products and services you consent to any such amendments. This Privacy Policy explains:

How we collect personal information

We collect personal information about you by the following means:

  • when you or someone on your behalf, register for a course or membership
  • when you or someone on your behalf purchase a product or service from us
  • when you or someone on your behalf update your information on one of our websites
  • when you or someone on your behalf contact us
  • when we otherwise provide information or services to you or when your information is captured in the process of collecting information through the services we provide; and
  • when employees, learners, and visiting guests are captured by our security cameras in any of our screened areas e.g., reception and carpark. 

The kind of personal information we collect

We may collect personal information and data from the following sources:

  • our customer’s health and safety policies and practices (including information about health and safety incidents, hazard identification, and training)
  • third party data about our customers in connection to our services, including information from
    • WorkSafe New Zealand
    • Inland Revenue
    • Credit reporting companies
    • New Zealand Qualifications Authority
  • data and analytics on our customer’s use of our services
  • traffic, visitor information, and analytics relating to the use of our websites and other online aspects of our services.

We collect the personal information you give us or authorise others to provide to us (which may include your name, date of birth, email address, home address, emergency contact, photograph, identification, citizenship, residency details, education history, disability information and employer details). We may also keep a record of communications we have with you, information we obtain in the course for providing products and/or services to you and any information that you acquire from us.

When you make a payment through the Website, it directs you to a secure payment processing website for payments by credit card or direct transfer.  We do not collect or store your payment information but may collect and store transaction data and invoicing details.

If you choose not to provide us with your personal information, we may be unable to provide you with access to some or all of our services.


How we use and share your personal information: 

By accessing or using the services, the website, or by providing information to us, you consent to:

  • our collection of personal information and data in accordance with this policy
  • the onward transfer, processing, collection use, disclosure, retention, and storage of information and data as described in this policy.

We use your personal information for the following purposes:

  • to provide you with courses, products and services that you may have registered for or purchased from us
  • to reply to your queries
  • to comply with relevant laws and regulations
  • for any specific purpose which we will notify you of at the time your personal information is collected
  • for our administrative purposes (including debt recovery if relevant)
  • to protect our legitimate safety and security concerns
  • to improve your experience with our products and services
  • to communicate with you, this might include sending you surveys or asking you to participate in research to better understand how we can improve our products and services or to test new products and services

    • assist and enable us to use your personal information to support the delivery of our courses, products, services to you, or the information you have requested
    • perform tasks on our behalf (such as website maintenance and development, data analytics, survey operators or research partners).
  • to publish client’s health and safety ratings and assessments to the SiteWise website to be available to companies that use the SiteWise prequalification tool
  • to our affiliates and related entities
  • to our professional agents when required
  • to any person you authorise us to disclose information to
  • by written request to government agencies
  • if we are required to do so during the course of legal proceedings or other investigations

How we use cookies

We may use “cookies” and collect session information to provide you with access to tailored information and services. A cookie is a small data file the Website sends to your browser, which may store it on your system for later retrieval by the Website.

Cookies record information about your online preferences and allow us to tailor what you see to your interests. Users have the opportunity, (using their browser settings) to set their devices to accept all cookies, to notify them when a cookie is issued, deleted, or not to receive cookies at all.

Information supplied by cookies and session information can help us to analyse the profile of the Website’s visitors and help us to provide a better user experience.

The Website, any news updates, or other communications we have with you may contain links to third-party websites. Unless expressly stated otherwise, these websites have not been developed by or controlled by Site Safe. They are provided for your convenience only, and do not imply that we check, endorse, approve, or agree with the privacy practices of the third-party websites linked to. We encourage you to be aware when you leave our website and to read the privacy statements of each and every website you visit.

How you can access/amend your personal information

You may provide and update any personal preferences you may have regarding our courses, products, or services through the 'My Site Safe' page on the website, and these may be used for the purposes of providing you with information that we think may be of interest to you.

To access the personal information being held by us, or to request a copy, or to request a correction to that information, please contact the privacy officer on privacy@sitesafe.org.nz , and we will comply with any request to the extent required under applicable law:

  • If you wish to access or change your personal information, we may ask you for additional information to confirm your identity and for security purposes, in particular before disclosing personal information to you.
  • If you request access to, or a copy of, your personal information, we will provide you with a copy of the personal information we hold:
  • If you request a correction and we agree that your personal information needs correcting, an amended record of your personal information will be provided.
  • If you request the removal of your personal information from our systems, we will delete it, noting that this will impact our ability to provide products and services to you in the future, and that this removal only relates to personal information, and does not include the activities you have undertaken with us in the past.

Release, amendment, and removal of personal information are subject to legal and other permissible considerations, we will make every reasonable effort to respond to your request promptly or inform you if we require further information in order to fulfil your request.

We may not always be able to fully address your request, for example if it would impact the duty of confidentiality we owe to others, or if we are legally entitled to deal with the request in a different way.


How long we hold personal information

We will keep your personal information for only as long as necessary for use in connection with the purpose for which it was collected.


Protecting personal information and data

We will take appropriate steps to ensure that your personal information is managed, stored and transferred in accordance with applicable law to protect your privacy rights and interests. To this end:

  • where we transfer your personal information to third parties who help provide our products and services, we obtain contractual commitments from them to protect your personal information; or
  • where we receive requests for information from law enforcement or regulators, we validate these requests before any personal information is disclosed; and

Information may be hosted internally or by third party cloud services, and as a result, personal information and data may be processed and stored outside New Zealand. By providing personal information, Employees, Learners, and Clients acknowledge that some third-party service providers may be in countries which do not have the same level of privacy laws as New Zealand and they consent to the transfer of personal information in these circumstances.

You have a right to contact us for more information about the safeguards we have in place (including a copy of relevant data protection measures within contractual commitments) to ensure the adequate protection of your personal information when this is transferred as mentioned above.


Legal rights around managing your privacy

We are committed to protecting the security of your personal information and we take all reasonable precautions to protect it from Privacy Breaches, namely:

  1. unauthorised or accidental access, disclosure, alteration, loss, destruction of your personal information; and
  2. actions which prevent us from accessing your personal information on a temporary or permanent basis.

If your personal information is subject to a privacy breach which causes or is likely to cause serious harm, we will notify you and the Privacy Commissioner in accordance with our obligations under the Privacy Act 2020.


Amendments to this Privacy Policy

From time to time, it may be necessary for us to renew or revise this Privacy Policy. The Privacy Policy was last updated July 2022. We reserve the right to change or replace this Privacy Policy at any time.
